Litigating disputes all the way to trial and judgment involves an immense amount of risk for each party. Who will the jury believe? Will a trial on the merits result in a winner-take-all and loser-take-nothing result? What if the other party files an appeal? No other process in civil litigation has had better success at controlling these risks than the process of mediation. Mediation can take many forms, but most often it works like an informal settlement conference where each party states its case and settlement positions to a neutral third-party, called a Mediator. The Mediator helps each party see the strengths and weaknesses in their case and seeks to facilitate a binding settlement agreement between the parties.
